1.1 Introduction & Definitions

These Terms of Service, together with our website policies, govern our relationship with you.

Company: DSCHOLAR RESEARCH CONSULTANCY AND ANALYTICS (OPC) PRIVATE LIMITED.
Client: Any individual, student, researcher, or entity engaging our services.
Services: Research consultancy, data analytics, and educational career guidance provided by the Company.
Agreement: These Terms of Service and all incorporated legal policies.

1.2 Acceptance of Terms

By engaging our services or placing an order through our website (dscholarresearch.com), you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service.

We reserve the right to modify these terms at any time. Continued use of our services after updates are published constitutes full acceptance of the revised terms.

2. Scope of Services & Responsibilities

2.1 Scope of Services & Client Duties

The specific scope, analytical deliverables, and project timelines are detailed in individual service proposals or project agreements.

Provision of Data: Clients must provide accurate, complete information, data, and research context necessary to complete the project.
Timely Cooperation: Clients agree to cooperate in a timely manner to prevent project delays.
Accuracy Guarantee: Clients warrant that all supplied datasets and materials are accurate and legally obtained.

2.2 Company Responsibilities

We commit to performing research consultancy and data analytics services with due care, professional skill, and technical diligence in line with industry standards.

Quality of Service: Rigorous methodologies applied to all analytical deliverables.
Confidentiality: Strict protection of client data, intellectual property, and business details as outlined in our Privacy and Ethics policies.

3. Payment Terms, Refund Policy & IP Ownership

3.1 Payment Terms & Refund Policy

Payment Terms: Fees are set forth in individual project proposals or website checkout options. Invoices are payable as agreed or within 30 days of invoice date. Late payments may accrue interest at 1.5% per month or the legal maximum.

Refund Policy: Refunds and session cancellations are governed exclusively by our dedicated Refund & Cancellation Policy, including EU Right of Withdrawal provisions.

3.2 Intellectual Property Ownership

All intellectual property rights arising from customized research consultancy or analytical projects performed for clients are transferred to the Client upon final completion of deliverables and full settlement of all outstanding invoices.

Upon full payment, the Client is granted a perpetual, worldwide, royalty-free license to use, modify, and distribute the final deliverables for their intended purposes.

4. Limitation of Liability, Termination & Legal Jurisdiction

4.1 Limitation of Liability

To the maximum extent permitted by applicable law, the Company’s maximum aggregate liability to the Client for any claims arising out of or in connection with our services shall be strictly limited to the total fees paid by the Client for the specific project concerned.

In no event shall the Company be liable for indirect, incidental, consequential, special, or punitive damages.

4.2 Termination & Governing Law

Termination: Either party may terminate an ongoing consultancy agreement upon 30 days written notice. The Client remains obligated to pay for all services rendered up to the effective termination date.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of India. Any legal disputes shall be subject to the exclusive jurisdiction of the competent courts in West Tripura, Tripura, India.
